(1) the evolving standards for what constitutes ‘reasonable’ cybersecurity in the US and around the world, with an emphasis on Internet of Things and critical infrastructure, (2) recent case law- including the US Supreme Court case of Carpenter v. United States in which the Court emphasizes that Big Data is Different and old privacy law may not suffice, and (3) the need to consider the creation of a governance regime that recognizes the big data can be transformed, through inference-making, into other, more historically sensitive information that may deserve level of protection.
